A 39-year-old Forward Muchavhera from Bikita in Masvingo, Zimbabwe has been sentenced to 14 years in prison for fatally assaulting a fellow villager after she professed ignorance about his wife’s whereabouts.
Muchavhera, who was 37 years old at the time he committed the offence, pleaded not guilty to a murder charge when he appeared before High Court judge Justice Charles Hungwe at Masvingo High Court Circuit.
However, Justice Hungwe found him guilty of murder with constructive intent and sentenced him to 14 years’ imprisonment.
The court found extenuating circumstances in that he had been convicted of murder with constructive intent.
For the State, Ms Tineyi Matenga said that on 7 August 2010, Rhoda Muchacha, who was 23, was at home seated outside her kitchen hut with her stepdaughter Ms Sophia Savaruka.
The court heard that Muchavhera came asking about the whereabouts of his unnamed wife to which Muchacha professed ignorance.
However, Muchavhera insisted on being given a satisfactory answer.
Muchavhera, who had safety shoes on, kicked Muchacha on the chin once and she ran into the dining room.
He followed and further assaulted her with fists several times on the head and face.
She got out of the room and ran towards the cattle pen but Muchavhera gave chase and caught up with her and tripped her to the ground.
While on the ground, Muchavhera savagely kicked her several times on the head and face.
He then sat on the now deceased’s stomach while assaulting her with fists several times in the face.
Muchavhera could not be deterred by the woman’s calls for help and continued to assault her until he was restrained by two men who were passing by.
When the two men left he resumed assaulting her.
Ms Chipo Murambiwa arrived at the scene and pleaded with Muchavhera to stop assaulting Muchacha, who was now injured.
As if possessed, Muchavhera was unfazed and he assaulted Ms Murambiwa resulting in her running away.
His reign of terror ended when another villager, Mr Muzondi Svaruka, arrived at the scene and grabbed him from behind before tying his hands using a rope.
Muchacha was left badly injured and was ferried to the hospital with the assistance of a fellow villager.
She was admitted at Silveira Mission Hospital before being transferred to Harare Central Hospital where she died on 17 August the same year.
