A 31-year old Zion Apostolic Church member struck a church elder in the face with a stone before threatening to set him on fire after a heated argument over bottles of wine that the church had bought for Holy Communion.
This was heard when Life Mlilo (31) of Mzwapansi area in Nkayi was sentenced to six months in prison by Nkayi resident magistrate Mr Ndumo Masuku after being found guilty of assault as defined in Section 89 of the Criminal Law (Codification and Reform) Act, Chapter 9 :23.
The court heard that the accused hit a church elder, Mr Dumisani Ndebele of the same area, in the face with a stone after he restrained him from destroying bottles of wine that the elders were about to give to congregants.
Prosecutor Mr Maxwell Hapanyengwi said sometime in April, there was a church gathering of the True Followers in Zion Apostolic Church in Mzwapansi area, Nkayi.
While at the church there was an argument over the type of wine that the elders had bought. Mlilo insisted that the elders had bought the wrong wine. The court heard that the elders tried to talk amicably with Mlilo, but he would not listen.
Instead, he threatened to destroy all the bottles of wine that were set at the table before they were given to members of the church. Ndebele then grabbed Mlilo by the hand and dragged him outside the church where he is said to have told him that he was making unnecessary noise. Mlilo responded by picking up a stone with which he stuck Ndebele in the face.
The court further heard that Ndebele sought refuge in the church with his assailant, who had picked up a burning log from the huge fire that was outside, in hot pursuit. The church members finally managed to apprehend Mlilo, who had no legal representative in court.
