A 67-YEAR-OLD Honde Valley man was recently slapped with a 15-year jail term for raping and impregnating his 15-year-old mentally-challenged grandchild.
He will, however, serve a 10-year effective jail term after five years were suspended on condition of good behaviour.
The man, whose personal and residential details have been withheld to protect the identity of the victim, has since approached the High Court seeking bail pending review, arguing he was wrongly convicted because the complainant is aged 16 years and not 15, as stated by the State.
The senior citizen submitted he pleaded guilty to the charge because he was coerced into doing so by police officers investigating the matter.
The lawyer said: “It is submitted that the applicant was severely assaulted by the police and he sustained severe injuries. He was forced and threatened to plead guilty to the charge or else he would disappear. He was denied access to his legal representation and even denied food and access to at least his relative.”
Allegations leading to the man’s conviction were that sometime in November last year, the girl visited the convict’s homestead.
The court heard, on a date unknown to the State, the convict’s wife went to her fields, leaving her husband and the girl at home. The man then took advantage of the girl’s mental status and lured her into his bedroom, where he sexually abused her.
The matter came to light when the girl’s mother discovered she was pregnant and when she quizzed her, she disclosed she had been abused by her grandfather.
She was then referred to hospital, where it was confirmed she was three months pregnant, but the pregnancy was terminated by consent of her parents
