SAMA Award-winning hip hop duo Deep Level Kgaogelo Kanyane and Lebogang Masiane, also known as Gaoza and Lebza, are accused of sampling Xitsonga artist HW Makhubela's song, Ngoma Ya Makanja, on their latest single without his permission.
The song in question is Teka Hi Leshi, which is due to appear on Deep Level's new album, Ithemba La Magumusha.
The song has been getting air play on radio stations since its release in May.
The original song was released in 1981 by Makhubela, who is living in Giyane, Limpopo. He told Daily Sun he is disappointed that Deep Level recorded his song without asking him first.
He said: "I want R175 000 as compensation because they failed to look for me before they released the song. I was surprised to hear my tune on the radio.
"I want Gaoza and Lebza to come and see me at my home to discuss the issue.
"My only income is my government pension and sometimes a payment from the Southern African Music Rights Organisation (Samro)."
Deep Level's manager and CEO of 360 Street Music, Thabiso Khati, said: "We have been trying to contact Makhubela for a long time, but every road we took was a dead end.
"The song was released as a sample single and it has not yet been released commercially because we were waiting to get in touch with him."
He told Daily Sun they would go to Giyane next week to discuss the matter with Makhubela.
Pfanani Lishivha, from Samro, said the organisation was willing to host a meeting between Makhubela and the members of Deep Level.
Lishivha said: "Our members need to notify us each time new works are authored and composed. We also advise members to let us know of any infringements of their intellectual property."
