A COUNCILLOR from Bulilima District has been dragged to court by his stepmother on allegations of stealing property amounting to 48, 500 rands from the complainant.
Plumtree magistrate, Livard Philimon heard how Clr Zoolakes Nyathi, 54, took advantage of the death of his father and used the opportunity to take Priscilla Nyathi's property.
He stole nine cattle, three donkeys and 10 blankets from the complainant.
Prosecuting Paul Mpofu narrated how Clr Nyathi robbed his stepmother and later claimed that the property belonged to his late father.
He is facing three counts of theft.
"On March 3 in 2008 the Nyathi family was gathered in Mbimba Village, Madlambuzi area for the disposal of cattle which belonged to the complainant's late husband. The cattle were allocated and the accused person went on take nine more cattle which belonged to the complainant and claimed that they belonged to his late father," said Mpofu.
He added: "The accused person then tampered with his stepmother's stock card so that she could not prove that the cattle were hers."
The accused person further demanded his late father's clothes and in the process stole 10 blankets belonging to the complainant.
On an unknown date in the year 2009 the accused person stole three donkeys from the complainant and claimed that he had bought them for his father and he wanted them back.
The value of all stolen property amounted to 48, 500 rands.
In her statement in court the complainant said "My step son has been tormenting me ever since the death of my husband. He has been fighting with me over my property and the property which was left behind by my late husband.
"I have tried several times to retrieve the property which he stole from me but every time I raise the issue he starts insulting me and intimidating me," said the complainant.
On mitigation Clr Nyathi denied the allegations and stated that he only assumed control over the property which belonged to his father as he was the rightful owner to the property.
He declined ever taking property which belonged to his step mother and tampering with her stock card. He was remanded out of custody to January 2.
