Policeman fails to ascertain son's age in court

A Bulawayo based police officer was lucky to have the courts scrap off maintenance from his shoulders after he failed to ascertain when his son was born.
The cop, Tshaka Ndlovu had dragged the mother of his 18-year-old son to court seeking for an order to stop paying maintenance and they appeared before Magistrate Victor Mpofu.
"Your Worship I am not so sure when my son was born but I know it was sometime in 1994. I cannot continue paying maintenance for him though because he is now above 18 and now employed as he is training to be a police officer as well. He will soon start making his own money and I do not see a reason why I should continue paying maintenance," said Ndlovu.
Magistrate Mpofu asked Ndlovu if he had any documents to prove that his son was over 11 years of age and he failed to produce them. In her response, Sifiso Ncube reminded Ndlovu that their son was born on January, 1 in 1995 and however concurred with the fact that her son was over 18.
"Our son was not born in 1994 but in 1995. I am in agreement that He should stop paying maintenance but this man has been failing to pay my son's fees as ordered by the court in 2010. I therefore appeal for advice to help me recover the money I used to pay fees for my son,' said Ncube.
Magistrate Ndlovu ruled in favour in Ndlovu and told Ncube to go and claim her money from the civil court.
